Terms of Service

The terms that apply when you use Vixxxen. This is the same text shown in the Vixxxen app.

1. Acceptance of Terms & Eligibility

By accessing and using Vixxxen, operated by Digital Divas, LLC ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service. You must be at least 18 years of age (or the age of majority in your jurisdiction) to access or use the Service. By accessing the Service, you warrant and represent that you are 18 years of age or older. If you are under 18, you are strictly prohibited from using this Service.

2. Description of Service

Vixxxen provides AI-powered image and video generation tools for creating digital content. You acknowledge and agree that the content generated is created by Artificial Intelligence and may not be accurate, realistic, or grounded in fact.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Billing, Subscriptions, and Cancellations

Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the applicable pricing and payment terms.

  • Authorization: By providing a payment method, you authorize us (and our designated payment processor(s)) to charge the applicable fees to your designated payment method.
  • Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled at least 24 hours before the end of the current period.
  • Cancellations: You may cancel your subscription at any time via your account settings dashboard. Cancellation will stop future billing but will not result in a refund for the current billing period.
  • Refund Policy: All purchases are final. Refunds are granted solely at our discretion or where explicitly required by applicable law.

5. Acceptable Use Policy

You agree not to use the Service to generate, upload, or share:

  • CSAM (Child Sexual Abuse Material): Content depicting minors or individuals under the age of 18 in a sexualized manner. We have a zero-tolerance policy for CSAM and report all instances to the National Center for Missing & Exploited Children (NCMEC).
  • Non-Consensual Imagery: Deepfakes or realistic imagery of real people without their explicit consent.
  • Illegal Content: Content that promotes violence, terrorism, or violates any applicable laws or regulations.
  • Infringement: Content that infringes on the intellectual property, privacy, or publicity rights of others.

6. User Representations Regarding AI Generations

You represent and warrant that any content you generate using the Service depicting a human or humanoid figure represents an individual who is 18 years of age or older.

7. Intellectual Property and Commercial Use

Subject to these Terms, our usage policies and applicable AI model licenses, you own the content you generate using the Service. You may use it for personal or commercial purposes, including publishing or selling it on third-party platforms. You are responsible for following the rules of any platform where you publish it and all applicable laws.

You represent that you own, or have permission to use, any images or other material you upload to the Service.

The Service itself, including its software and AI models, remains the property of Digital Divas, LLC. You grant Digital Divas, LLC a worldwide, non-exclusive, royalty-free license to host, store, process, and display your content as necessary to provide the Service.

8. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice or liability. Upon termination, your right to use the Service will immediately cease.

9. Modification of Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service with a new "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.

10. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Digital Divas, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.

13. Email Communications

When you create an account we'll send you product updates, tips and offers by email. You can opt out at signup or anytime using the unsubscribe link in any email. Account and billing emails are still sent.
